Do you need a solicitor to buy a new build house?

While it isn’t legally required, it’s highly recommended that you acquire the services of a conveyancing solicitor when buying a new build property.

Buying a new build property can be challenging because the house may not be fully built when you start the buying process. As a result, you should use a conveyancing solicitor to complete essential tasks during the new build conveyancing process.

They’ll understand the legal process of purchasing a new build and can help you navigate non-compliant discrepancies with site plans, specific new build property inspections, like the National House-Building Council’s (NHBC) control service, incomplete agreements and failure to confirm plans.

At GD Property Solicitors, we’ve managed the new build conveyancing process for people all over the UK, and we can help you, too.

Why choose us as your conveyancing solicitors

There are plenty of reasons why we believe you should choose GD Property Solicitors as your house sale solicitor.

As the seller’s solicitor, we ensure that the entire process is handled carefully and efficiently so you can focus on other things. We complete all of the legal work professionally and swiftly to reduce delays that can often occur during a property transaction.

Here’s what else we can offer you:

Online conveyancing solicitor

One of the main features of our service is that everything is handled online and can be done from the comfort of your home. You won’t need to take time off work or rush around at school pick-up to head to an office to physically sign documents, or bring us stacks of paperwork – everything is online.

In our 24/7 online portal, you can view and sign documents, make payments and more. We’ve found this speeds up the entire process and reduces the risk of documents being lost or damaged in transit.

Clear communication

At every step of the process, we’ll keep you updated so you’re not left in the dark feeling anxious. We understand how stressful a house sale can be, so we’re determined to remain transparent at all times. Plus, if you have any questions for us about exchanging contracts, the buyer’s deposit, completion day – or anything else – we’ll do our best to answer them.

Trustworthy service

We’re an extremely trustworthy and reliable team of conveyancing solicitors. We have years of experience managing the conveyancing process for people all over the UK, in major cities and small towns, so we can help you. We believe in our process so much that we offer a ‘no completion, no fee’ promise if your sale falls through.

Affordable conveyancing fees

If you’re worried about paying too much money to sell your home, don’t worry. At GD Property Solicitors, we offer an affordable fixed-fee rate without any hidden fees so you know exactly what you’re getting. With us, you’ll receive excellent value for money for a swift, efficient conveyancing process.

We have the expertise to handle the legal process, which is usually conducted in around four weeks with new builds. We’ll look into your mortgage offer, liaise with the developer’s solicitor, check for any restrictive covenants, and handle everything related to your property purchase.

This includes the exchange of contracts, transferring your deposit and final funds for the property, and registering your legal ownership of the home.

What is the new build conveyancing timeline?

Due to the lack of chains and existing homeowners, a new build purchase is traditionally quicker than a standard purchase on an existing property.

The conveyancing process starts when you reserve the property. It then moves quite quickly through the remaining stages. Here’s how a new build conveyancing process works:

  1. Reserve the property – Usually, you must pay a non-refundable reservation fee of around £500 to £2000 when purchasing a new build. As long as the property transaction goes through as agreed, this fee is deducted from the final purchase price.
  2. Instruct a conveyancing solicitor – As soon as you’ve put your offer in on the house, the conveyancing process begins, so it’s time to acquire the services of a professional – preferably one who has experience dealing with new builds.
  3. New build conveyancing checks – The conveyancing process usually takes only four weeks from reservation to exchanging contracts, so this shouldn’t take too long. Your conveyancing solicitor will check if the relevant planning permission has been granted and that the building work followed it. Your conveyancing solicitor will check several things, including whether the property is leasehold or freehold.
  4. Snagging survey – The developers do not allow entry into the property until construction has been completed, but you must arrange a snagging survey to highlight any issues – small or large – that must be repaired. If you’re unable to get a snagging survey done at this stage, your solicitor should ensure it’s written into your contract that any issues found by a survey will be fixed after the completion date.
  5. Pay the deposit – You now pay the deposit just as you exchange contracts. The deposit should be at least 10% of the total property value, but it could be as much as 30%.
  6. Exchange contracts – Once all the checks have been made, your specialist new build conveyancer will proceed with the exchange of contracts. You will also pay the final balance on the property, with the money provided by your mortgage lender.

Completion date – The final day of the process is when your conveyancing solicitor will transfer the funds, and you’ll receive the keys.

I recently completed both the sale of my old property and the purchase of my new property, Isaac Randle provided outstanding service throughout. His communication was clear, his professionalism was exceptional, he consistently went above … More and beyond to keep everything running smoothly. On completion day, the purchase of my new property was delayed past 5pm due to issues on the buyer’s solicitor’s side completely outside Isaac’s control. Despite this, Isaac stayed on past his working hours to ensure everything was finalised that same day. His dedication and commitment made a stressful situation far easier, and I’m genuinely grateful for the effort he put in. Isaac is a credit to his profession, and I highly recommend him to anyone needing a reliable, proactive, and supportive solicitor.
