Will I be kept up-to-date with progress?

Does the solicitor have to be local, signing document and id checks etc?

A solicitor’s local knowledge of the area is always something that could prove to be useful and of a benefit to you in your sale, however, conveyancing is very widely done across the country by solicitors/conveyancers for clients, as a personal knowledge of the area is not specifically required.

The conveyancer acting for you in your sale will obtain evidence of your title from a central Land Registry portal, and this is what a buyer’s conveyancer will use to check and prove the title; again, they may not be located locally to the property in question. Your personal knowledge will inevitably be called on.

With regards to having documents signed and contact with you, don’t be worried if your solicitor/conveyancer is not local to you, as again it is quite normal that all documents are sent to clients via post, email, or phone as opposed to historically having clients in to the office for attendance meetings. This has speeded up the conveyancing progress and also helps to meet client’s expectations in line with clients’ busy lifestyles and work commitments. This has also allowed conveyancing to be carried out on English properties where clients live abroad.

It should also be noted that the cheapest quote is not always the best service, and reputation and recommendations do hold weight, you should also ensure the cheaper quote includes everything at the outset. The estate agents will probably have a referral agreement with the solicitors they are recommending to you, who will pay them an instruction fee per referral, this is very common and helps firms to build relationships with each other and clients.

An Internet search for conveyancing services is often a good starting point, as these days most property lawyers will have an online presence.

Be sure to scrutinise quotes from online conveyancers very carefully before signing up. It’s not unusual for firms to attract customers with a very cheap headline rate, such as “£99 conveyancing”. This is a misleading base rate and will not include the other fees and “disbursements” that form an inevitable part of the conveyancing process. Disbursements are third-party charges that the conveyancer will collect from you and pay on your behalf – for example land registry charges and fees for searches.

Full online conveyancing

While many conveyancers with an online presence still operate a fairly traditional business model, many now offer a full online case management system. This has the advantage of considerable transparency compared to more traditional conveyancing practice. Typically you will be able to log into the conveyancer’s online system and view the case progress at any time, seeing which searches have been requested or received and tracking the status of the mortgage application. Some online conveyancers also send automated text alerts when particular milestones in the conveyancing process are reached.

How long will the conveyancing process take?

Many first-time homebuyers are surprised when they learn how long the process of purchasing a property can actually take, with the time frame from first viewing a potential new home to finally moving in often measurable in terms of months rather than weeks.

The conveyancing process

The time frame from first instructing a conveyancer to actually moving into your new home typically takes somewhere between eight and twelve weeks. However, it’s important to remember that this is just an average. If you’ve already got the ball rolling with your mortgage application and only straightforward “searches” (more on this below) are required, you may be able to move in more quickly. On the other hand, if either the property survey or the conveyancer’s searches throw up something unexpected, further work may be required and completion of the purchase could be delayed until any queries are resolved.

As part of the service they provide, your conveyancer is responsible for reviewing documents relating to the pending house purchase and providing you with the necessary legal advice. These documents will include the contract pack obtained from the seller’s solicitor, your mortgage offer (including its terms and conditions), and the property survey. Any one of these might bring up issues that need to be investigated and resolved before the purchase can proceed – for example, most surveyor’s reports specifically include legal notes intended for the conveyancing solicitor, relating to factors such as building control and planning issues, and guarantees.

A vital part of the conveyancer’s role is in carrying out “searches” relating to the property and grounds. These searches are usually carried out via the local authority and cover matters such as the property boundaries, rights of way, boundary disputes, planning constraints and so on. Depending on the location and the nature of the property itself (for example, its construction type or freehold/leasehold status) further non-routine searches might be called for. Searches can turn up information that will be vital to you as the future owner of the property – such as subsidence or flood risk – so the time and effort spent on this part of the conveyancing process is extremely important.
