The Building Safety Act 2022 created some challenges for conveyancing solicitor firms handling the conveyancing process for buildings five or more storeys high.   • New roles and responsibilities – The Building Safety Act created new roles, such as ‘Building Safety Managers’ and ‘Accountable Persons’. Their compliance must be verified by conveyancers.
  • Safety charges – The costs associated with building safety remediation work must now be assessed and communicated to potential buyers.
  • Leaseholder protections – There are certain protections in place for qualifying leaseholders, shielding them from the costs of historical safety defects. This adds more complexity for conveyancers to determine eligibility.
  • Information gathering – Conveyancers must now obtain documentation relating to building safety, such as the Leaseholder’s Deeds of Certificate and Landlord’s Certificates. These can be difficult to acquire.
  • Increased insurance premiums – Professional indemnity insurance providers are also likely to scrutinise conveyancing law firms handling high-rise transactions more closely. As a result, they could increase insurance premiums because of the perceived higher risk.
